Legal Question in Insurance Law in Texas

My wife was in a fast food drive thru waiting for food order when an 18 wheeler hauling corn came off of the freeway, down the embankment, and plowed into her while parked, and also damaged the back of the restaurant. The driver supposedly had an aneuorism that caused him to black out. Is his insurance company liable. My wife is a teacher and is out for a year, getting chiropractic help 3 times weekly, cant sleep, and is in constant pain.

I am very sorry to hear about your wife's accident. It sounds like it was a terrifying ordeal. If the driver, in fact, did have an aneurysm, then it might be difficult to prove legal liability against the truck driver or the trucking company. However, the issue may not be a simple as that and an in-depth investigation is certainly warranted here. Since this involves a trucking company and some very serious injuries to your wife, you would be well advised to consult with an attorney.
