Legal Question in Intellectual Property in Texas

New company based on old company

If I were to start a new company based on the practices of the company I currently work for can I face any legal recourse? They have a no-compete clause but I didn't sign it. The company's current practices are all based on using products that anyone can go and buy and use. They claim to have ''trade secrets'' and the like, but there truly isn't anything they are doing that they ''created''. There are several other companies that do a variation of the same thing with the same or similar equipment.

What you describe might be possible. But an attorney would need to get more facts from you to give a reliable opinion. E.g., read your contracts with your employer.

Depending upon how irritated they would be with you, you may expect a suit for theft of trade secrets. They may not have a case, but you'd be looking at the cash and time drain of litigation while you're starting up.
