domain name ownership

i have leased a domain name and had a webmaster design my site 25 days ago. He was supposed to invoice me net 30 days. we have never received an invoice.Tuesday we received a fax demanding payment.I called the person and informed him we have not received his invoice.His fax said it was the second request.Friday he shut down the site before the net 30 terms and posted on my domain name that this site has been shut down for non payment and names my company. I have contacted the person and asked to remove that statement off of my domain name. He refused. My legal question is can he post information on my domain without my approval.This is damaging my business so bad that i might not be able to recover lost revenue by slandering my company. Since all my customers use the web site to generate sales.

What your webmaster appears to have done, at least from what I can gather from your post, sounds wrong under several different areas of law, including tort, contract, trademark, and unfair competition law. Just which legal theories you can pursue and what kind of recovery you can expect would require an additional inquiry into the specific facts involved, but it sounds like you probably have some form of legal redress (if not several) you could pursue.
