Legal Question in Intellectual Property in Texas

Hi, I am a graduate study working on a project about 2 years. I found one of the undergradyate students from the same department graduated last may,2011, by taking my research data without any reference and my permission. I am sure this is an act of plagiarism which effects very bad influence on my farther project. Can I ask our university to withdraw his thiese and sue that guy as well?

You can always notify the university and ask them to take appropriate action, whatever it may be. You can always sue but you must prove (1) that it occurred and (2) damages.
