Legal Question in Intellectual Property in Texas
Is it legal for me to read news articles, such as from CNN or Fox News, taking only the facts and summarize them into fully my own words, then post the summaries I created into my website?
1 Answer from Attorneys
Yes you can. Ideas and facts cannot be copyrighted. It is the way the article is written - words and phrases used, layout, and organization - that makes an article expressive and thus copyrightable. But watch out, if you summarize the article in a way that is still substantially similar to parts of the article then that may still be infringing.
Although copyright infringement may not be an issue, especially for news articles, which are very factual and less expressive in nature, you might be accused of plagiarism. However, there is no cause of action for plagiarism under the law.
