Recording television for gifts

My penpal in Japan recorded a television show she uses to learn English. Can she legally give me the tape as a gift? Can I legally record any TV show as a gift for her?

Your penpal should consult a copyright lawyer in her country, but I believe that her copying and distribution of a videotape of a TV show likely constitutes infringement. Your copying of a TV show in the US and distributing it (even as a gift) constitutes infringement in the US. Either of you can buy a videotape of the shows you'd like to share from their copyright owners and give them as gifts, though.

Copying a TV program, whether as a gift or otherwise, is a copyright infringement if you don't have permission to copy it.

Write to the program and ask for permission, explaining the use and purpose.
