Juvenille Defered Ajuticated Probation

dear lawyers,

WEe have a 14yr old son who has never been in trouble until now.he and three friends broke out windows at a local school.they admitted thier guilt.instead of splitting the cost evenly among the four,they have decided to charge each child with the full amount of cost.i think it is so they can raise the offense to over 500 but under 1500 and charge them with a class a mis dameanor.but my question is what is the law about getting deferred ajuticated probation so if my son decides to join millitary or other law enforcement agencies later in life,it will not apear on his juvenille record. can it be kept of his record if they use deferred?

There is some information about juvenile charges at my web site: http://www.reasonable-doubt.com To answer your question, Deferred Adjudication is part of the criminal law and juvenile proceedings are technically civil law. There are a couple of things which are juvenile counterparts to deferred adjudication, but you really need to have a lawyer interact with the government on this issue. The school should only be paid once for the damage (not three times), but all the parties should be fully responsible to see that the damage is fully paid. Also, if the parties worked with each other to break the window (the one breaking the window and a "lookout" and a "getaway driver" for instance) all can be held accountable. FIVE hundred dollars seems a bit much for one pane of glass. If you have a photograph of the damage, you might contact a glass repair man and ask the charge for that type of repair.
