Legal Question in Employment Law in Texas

Age Discrimination

I am writing this on behalf of my husband. He and a coworker both Anesthetists are beginning to feel as if there is an age discrimination situation brewing within the surgery center where they both are employeed.

Both are 65+ years old. At work they are being watched like hawks for mistakes. Whereas the younger anesthetists are left to themselves. This makes an already difficult job more difficult.

Younger employees with less education have been hired for a lot more money than either older employee is now making.

This morning a statement was made to the effect that they need to retire as the company wants to hire a few younger employees. Statement was made by the doctor in charge.

In a situation such as this what can be done to protect their interests. We are afraid that they may soon be dismissed with 90 day notice as stated in their contracts for no reason other than age.

Thanks for any information or help.

Re: Age Discrimination

It certainly appears they are being set up for termination, and that age is a motivating factor. I would discuss your preventative options, and your legal rights, with a qualified employment attorney.
