Legal Question in Employment Law in Texas

Automatic resignation

Our company recently added in new policy to the employee handbook, and we had to agree to sign it. The new policy in question states that if the company happens to find out you are actively searching for another job i.e. human resources receiving a job verification, they have the right to automatically resign you from you current position with the loss of all benefits. Is that legally possible?

Re: Automatic resignation

Yes, except for any benefits to which you have statutory entitlement, such as COBRA, or some contractual right. This is because, unless you have an employment contract with them, you are an employee at will, and they would not even need to have this "reason" as a basis to terminate you.
