Legal Question in Employment Law in Texas

collection commission check from company

Hello,

My husband worked for a start up company for over a year. He was told that funding was solid. He closed several deals and was supposed to get paid a percentage per his contract. His employer kept putting off the payment. At the last company meeting , the employees were told that they would not make payroll next month and they would like for them to stay but could work from home until the issue was resolved. My husband started looking for another job and when his employer found out, he sent him a termination letter via mail. He was not offered any severance, nor have they paid him the commissions still owed. My question is do we have any legal recourse? The amount is around$15,000. Is it worth fighting for? The company is still in business.

Regardless of whether there is a written contract, based on your facts, it sounds like you would have a pretty solid breach of contract case against the employer. I have handled similar cases and have reached settlements very favorable for my clients. Contact me for a free consultation. www.nemeclaw.com
