Commission Sales Not Paid

My boss does not pay owed commissions from prior sales if a salesperson quits. Is that legal?

the salespersons could go to Court and collect..JP can collect up to 10,000...and one could repport to the Texas Workforce Commission..

it is probably NOT a crime but that does not make it legal
