Legal Question in Employment Law in Texas
My Daughter received notice from previous county government employer (1 year after leaving) she was over paid during one month by $163.00. She responded with a registered letter agreeing to pay once the original time card was sent to her to verify the numbers. After additional 2 months of no response, she now is getting letters from collection agency with threat to take legal action. Is she obligated to pay this back? The place she worked had a very poor time card system of just notepad. She thinks there is no proof to the allegation of overpayment because of poor accounting practices.

She should stop talking to the collection agency folks. It's okay to hang up on people (we're always reluctant to do this). She shouldn't repay anything and should go on with her life.
