direct deposit delays while company refi's

I'm a contract engineer, working for a staffing company. In recent weeks, my weekly direct deposit payments have been delayed a couple of times; by a few days in each instance. My employment is such that I am to be paid weekly. After expressing my concern to them, they suggested my switching to a partner staffing company until the corporate woes blow over. This companies� stock has plummeted as they are restructuring their finances and I really have no wish to remain on a sinking ship. Do these delays in payment somehow abrogate the contract I have with them? Of course another staffing company seems to think so, but I want to be sure before I jump ship. I like the client company I�m working for, but the terms of my contract state that I�d have to wait 6 months beyond leaving the staffing company before I could go back as either a direct or indirect employee.

The contract will probably be upheld..and you should talk to principals..and amend contract..or stiff it out
