Legal Question in Employment Law in Texas

Employee drug use

I suspect an employee (involved in patient care) may be using cocaine (maybe even during office hours). How do I address this issue? Random drug test? If positive how do i terminate employment?

Re: Employee drug use

If you are an employer, you should have an established drug testing policy. If you have a reason to believe someone is using cocaine, especially if he or she is putting others at risk, you probably should terminate immediately. Best advice is not to give a reason, but there are many factors that should be explored with an employment law attorney before you do so and it is impossible, and inappropriate, to provide specific legal advice without knowledge of all the factors involved.
