Legal Question in Employment Law in Texas
Employee rights after signing a severance package agreement
I was recently laid off due to cut backs. I have never had any type of disciplinary action against me. I found out at the same time that at least one (and probably 2 more) other persons was hired for the same job, but at another location. I could have easily been transferred, but i was never given that option. I am pregnant and the company was aware of this. I really didn't think everything through before I signed a severance package (only 2 weeks pay). The letter I signed release the company of me filing a lawsuit or their wrongful doing, etc. I mailed it to the corporate and i'm sure they have received it by now. Do I have any grace period to break the severance agreement and release? Or do I have any rights to claim that I was discriminated against when I was laid off? I am now in a position where I will have a difficult time getting hired somewhere else. Should I find a job and will no longer have the FMLA to protect me when I go on maternity leave.
thank you

Re: Employee rights after signing a severance package agreement
If the release you signed contained a waiver of any age discrimination claim, you probably have a seven day period in which you can revoke the signed release. Not sure if you'd have any other basis, but you need to show that agreement to a lawyer sooner rather than later.
