Legal Question in Employment Law in Texas

Employee/Employment Issue

I was terminated by my supervisor because I went to Human Resources about his verbal threats towards me and some actions that went against company policy. I tried contacting HR after my termination and they would not respond. Do I have any legal recourse for being fired by my supervisor? I know Texas is an at-will state, but am I not protected from being fired because my boss doesn't like me for going to HR?

Re: Employee/Employment Issue

You may be but you need an employment lawyer and most require some amount of retainer. Such cases become the credibility of witnesses...and if you can get another job, it mitigates damages but the firing will remain onyour record...so you have damages..

Re: Employee/Employment Issue

You may have a claim against your former employer for retaliation if in your complaints to HR you discussed discrimination based on your membership in a protected category such as race, age, sex/gender, national origin, religion, or disability. You may also have a claim if your complaints concerned any activity that you had engaged in that might be protected by federal law, such as the assertion of a right to medical leave or a complaint concerning overtime pay. Please contact my office should you wish to discuss this matter further.
