Can employer use your image (picture) for a promotion or film

with out the employee permission?

People, their heirs and assigns, have a general right to profit, and exclude someone else from profiting on their photograph or likeness. However, another�s use of one�s photographic image for editorial purposes is usually OK. Each case requires specific analysis. Legal counsel will be able to help you determine your rights as to each specific use of your photographic image.
