Family Medical Leave Act of 1993

Do learning disabilities fall under the FMLA? I have a child who is AD/HD and is a year behind in Math. He needs to be tutored outside of school in order to catch up to his class. I wish to take off 1 hour early from work each day in order to get him to the tutor, but my company is balking.

The short answer is "no", FMLA does not apply. There needs to be a serious health condition and, for periodic leave such as you are describing, that generally means caring for someone with a serious illness. Sorry I could not be more encouraging.
