Legal Question in Employment Law in Texas

Not hired due to erroneous info on background check

Recently I had a job offer rescinded because a former employer told them I had been ''discharged'' which is not accurate. In fact, I had a separation agreement because of a wrongful termination which included several months pay and language which described that the only information that would be given in a situation like this would be that I resigned, which I did. During the time that I became aware of this information and the fact that it cost me a lucrative position I worked with the comapany's Corporate HR to prevent this from happening again. However, I am still in the market three months later and now I have the facts in writing; I was not hired due to this negative information. Do I have any recourse with my former employer? If so, how do I get started?

Re: Not hired due to erroneous info on background check

Based on your representation, it sounds like a suit for slander, libel and possibly other causes...which may have to be filed within a year of the actions....and you should be ready to pay a lawyer, most would not take on a strict contingency
