Legal Question in Employment Law in Texas
They are holdingmoney from paycheck for insurance but insurance has been terminated. What recourse do I have?
1 Answer from Attorneys
The remedies you have depend significantly on what led to the insurance being terminated. If the employer terminated the insurance plan appropriately but payroll deductions were not stopped on time then you need to be paid back for the deductions and that may be the full extent of your remedies. However, if the plan was terminated due to plan mismanagement or the plan was improperly terminated then you may have remedies to recover the deductions plus other relief under federal law, particularly if you had medical bills that went unpaid by the insurance plan that should have been covered. You need to talk to an employment attorney in Texas who has experience with ERISA issues.
