Legal Question in Employment Law in Texas

Job Offers

I was offered a mgmt position 3 months ago, in which I was to get paid Salary. I got the job offer, i signed it, faxed it back, and in my october paycheck showed up that way. I went out of FMLA, and now that I have come back, my checks are showing to be HRLY. I talked to HR, and they said that I never got the position and that Im not a mgr. Do I have grounds to go after the company for not notifying me of a change in my employement status?

Re: Job Offers

You might. Under the FMLA, your employer is required to reinstate you into to the same position you held before taking leave under the FMLA or to a comparable position, with equivalent pay, benefits, and working conditions. It sounds like they may not have done that. I'd be glad to discuss this with you further if you are interested.
