Legal Question in Employment Law in Texas
Laid Off Prior to Completion of Contract
I was verbally given a job offer stating that I would be guaranteed employment for a minimum of 2 years, as well as how much I would be paid in those 2 years. I also received an e-mail from the hiring manager stating the same things. I never received any performance goals or guidelines with which I was to be held accountable to. 9 months into my employment, they laid me off stating that the territory I managed wasn't performing like they wanted it to. I was never notified at any time prior to this that my territory was falling short or underperforming. Is this considered to be a wrongful discharge? If so, could my employer be liable to fulfill the remainder of the salary that I was guaranteed?

Yes, your employer could be liable to fulfill the remainder of the salary that you were guaranteed. Whether they would be liable would probably depend on several things, including the language of the e-mail that the hiring manager sent to you. I'd be glad to discuss this with you further if you are not able to resolve the issue with your employer.

You may very well have a claim for a breach of contract, but with the absence of any written documentation, you may be confronted with some legal issues and practical problems of proof. You should provide me with your contact info upon receipt of this e-mail to discuss in greater detail. I look forward to hearing from you.
