Legal Question in Employment Law in Texas

Layed off

I was layed off for no reason after 29 years. I have on going medical issues due to a bypass in July. I was told my insurance ends today also. I know this was some of the reason I was released. I understand that by living in Texas I am subject to the At Will law. What can I do about the medical problem? Thanks

Re: Layed off

If your employer laid you off because of time you were taking off from work to care for the medical problem, they may have violated the Family and Medical Leave Act. If they laid you off because they perceived you as having a disability, they may be violating the Americans with Disabilities Act. I believe there is also a Texas statute that says that your employer has to continue you on your health insurance until the end of the month when you are terminated, and then they have to offer you the option under the federal COBRA law of allowing you to remain insured under the policy you had with them as long as you pay the premiums. I would be glad to discuss these issues further if you are interested in doing so.
