Legal Question in Employment Law in Texas
Layoff for medical
My husband recently recovered from heart bypass surgery. He has been placed on light duty as a fireman at a major defense company. He was told 6-12-08 that he needed a paper from his doctor saying he could work full duty including using an air pac for firefighting and if he didn't get the release he would be laid off 6-19-08. His doctor doesn't want to be legally responsible for his health in a firefighting situation. My husband has worked 29 years for the company and can retire now at 59. He is in the union. If he is laid off he will lose his insurance and may not draw his retirement until 65. Would it do any good to fight this layoff? His surgery was January 15, 2008.
