Legal Question in Employment Law in Texas
My mom works as an LVN for a nursing home. She works two 16 hour shifts on Sat Sun and gets paid for 40. This past week her supervisor called her on her regularly scheduled day off Mon and asked her to come to the facility 30 miles away to discuss a situation that occured over the weekend. My mom told them she would try to make it in, but it would not be likely that she could get there as she was engaged in other things on her scheduled day off. She was phoned by the supervisor on Friday and told that she was suspended for 3 days Sat, Sun, Sat for not returning the phone call. She has not received prior disciplinary action and there was no formal write up that she was asked to sign. The suspension comes to a total of 60 hours and over $1200 of unpaid time. Can the supervisor legally suspend her with no written documentation? Is she legally obligated to come in or call back on her day off?

Employers are not required to pay when not working..and are not required to give employee notice of discipline...Texas is a "business" friendly state..not a "worker" friendly...as are all Republican controlled states...
