i signed a non compete and am a general manager of a truck repair shop. Im leaving and wanted to start my own company and all the employees and customers want to come with me. the owner just got out of prison for a felony. can i leave and use his conviction as a way out.

Based on what you have written, it appears that you might be able to get out of the non-compete agreement. My local law firm would need to review the actual agreement to properly advise you of it's effects upon you. Additionally, the Texas state laws have changed recently regarding non-compete agreements. As such, you should seek the assistance of a local law firm in determining your rights under the agreement. Probably..but you would be wise to either be released or get a lawyer to look at agreement and advise you..
