Legal Question in Employment Law in Texas

Promissory note for relocation benefit

My employer requires that I sign a Promissory Note for relocation benefit. It states if I leave the company within 1 year I will have to repay a portion of the benefits I received for the relocation. If I decide I'm not happy in my new location and choose to leave the company can they pursue me for a portion of the money paid for relocation? The policy states the following:

Termination of Employment

In consideration of any and all costs associated with my relocation, I agree and promise to reimburse the

corporation a pro-rata share of such payment if within one (1) year from the effective date of transfer, I am

separated from the Corporations employ for any reason other than death, retirement, or termination under the

Involuntary Salaried Separation Program OR if I choose to find another location within the Company

prior to one year from the date of this application. I also agree that time taken on a special or geographic leave

will not be considered in the pro-ration.''
