Legal Question in Employment Law in Texas
Promotion Discrimination Laws
Is there a law that prohibits employers from denying a promotion to an individual that can not move to another location due to finacial impact of the move? I have an opportunity to be promoted to a Supervisor position in the located in the town I currently work in. However, I have been told that my inability to move makes me a less desirable candidate. I have been added to a succession list by my supervisor and am qualified for this promotion. It seems unfair to make a person move to another location just to suit an enterprise wide practice.

Re: Promotion Discrimination Laws
That appears to be a legitimate qualification on the employer's part. If it were a subterfuge for some other type of discrimination, you would have a legitimate charge, but simply requiring a move if it fits the employer's needs is well within the company's rights.
