Legal Question in Employment Law in Texas
I quit but they said I was fired
I worked for a daycare for almost 16 years never wrote up and we had gone through 3 directors in a year and a half and the center was going down hill fast and they hired a lady I did not get along with. On a friday when she wasnt there I had my kids combined with another teacher and while together I was moving things from one room to another. On Monday when the director came back she brought me in the office with no other witnesses and said that another teacher said I left the other kids unattended. I said no there was another teacher in the room with me it did not happen and she said well you are unhappy here you need to just give your two weeks and I will make sure you get your two weeks vacation. I got on the phone to my husband he said to quit so I wrote on a piece of paper I quit dated it and signed it. Couple of weeks later I get my cobra papers in the mail and it said I was terminated so I called the director and she said no that isnt right you quit dont worry about what it says. So I called unemployment and filed. They did their investigation found no wrong doing on my behalf and gave me my unemployment. Can they legally say I was fired and if not can I do anything about it?

Re: I quit but they said I was fired
Check with the unemployment office. When you quit, you are not entitled to unemployment benefits. when terminated without good cause, you are....Hence, tell employers why you "left"....and mitigate the damages...
