Refusal to hire disabled person/otherwise qualified

I am legally blind in one eye, I am also a truck driver by trade. I have been issued a vision waiver by the state of Texas which exempts me from the vision requirments for the commercial drivers license. I am currently employed as a truck driver.

I applied for a driving job. I was not hired. I was told to reapply. The company refused to tell me why I was not hired. I reapplied with the same result. The corporate office stated that I was not hired due to my disability. Can they discriminate like that? I am otherwise qualified, I have a valid license (with all endorsments including haz-mat) as well as a D.O.T physical card. The company was and is advertising that they were hiring drivers.

It appears you have been discriminated against unlawfully. You may wish to contact an attorney to explore the facts more fully, and you may have a basis to file a charge of discrimination with the Equal Employment Opportunity Commission.
