Legal Question in Employment Law in Texas

Short/Long-Term Disability

I worked for a consulting company that required 100% travel (Sunday through Friday night). I worked out of the country (UK and Canada) for 3/4 of my tenure where my insurance only covered emergencies. On Nov. 3, 2006, I was terminated due to lack of work. When I returned home, I immediately made the doctors appts. I had been putting off. I found out I have cancer, and will require extensive treatment. My health benefits were paid through Nov., and I am on Cobra now. Do I have any right to short- and long-term disability benefits from the company? The termination letter only mentioned my health insurance. Also, although I live in TX, the company's NA headquarters are in FL.

Re: Short/Long-Term Disability

You have a right to all insurance benefits in effect ..if the medical evidence supports your claim..Contact a lawyer experienced in insurance claims, particularly ERISA...ie company plans..and get all the documents before going to the lawyer..but of course, first go to the company and make your claims..
