Subcontractor vs. Employee

My husband was working for a HVAC company as an employee. They changed his employment status to subcontractor after about 9 mos. His title, job duties and hours all remained the same, the only thing that changed was the taxes and he went to salary. My question is; Can a subcontractor be salaried? Are subs entitled to overtime?

probably not...what are the facts..ie new hours/salaryvs hourly/other benefits, if any, eg health insurance?
