teacher's 13-month salary is paid wrong

a texas public school teacher requests yearly contract to be divided into 13 payments. district personnel neglected to withhold amount of initial check throughout year. district pays off contract early, thus leaving teacher and family without income until end of september two months. is teacher entitled to request/sue district for additional compensation?

If contract amount was fully paid, you have no reason or basis to sue.
