Legal Question in Employment Law in Texas

Unfair treatment - Discrimination

I recently requested a meeting to

discuss a transfer to a location closer

to my home. HR said another matter

has come up and that my supervisor

must be present. I received a notice

of warning, my boss suspected that

me and a former employee, who just

quit last month, were clocking each

other in and out, they said it was

evident by looking at the timesheets.

We never clocked each other in and

out, many times we carpooled,arrived

and left work at the same time. The

former employee was not questioned

about this, he left for another job and

was still eligible to come back as a

freelance employee, getting paid

double! HR said they have been

investigating for a while, but last

month I had a review based on my

performance and received a raised,

this issue was never brought up. I

feel that if there was any question

about my time sheet it should have

been addressed during my review

meeting and while the other person

was still employed. I feel that I have

received this notice to discourage my

request to transfer and ruin my

credibility for future promotions. The

allegations are false and I've

expressed that to HR.Is this unfair

treatment/discrimination?

Re: Unfair treatment - Discrimination

Again...the value of UNIONs...of course it is unfair but there is nothing you can do about it legally..unless you want to spend a lot of money and probably lose an effort to combat slander..

Obiously you have excellent skills...so go on with your life..transfer to another company as your friend did...Good luck
