Legal Question in Employment Law in Texas

I was on my way to work one morning when I wrecked my car. I was then arrested for dwi in Texas. I went back to work two days later and I was suspended without pay. I have not been convicted or found guilty. My lawyer says case will be dismissed. Now they want me to sign a resignation letter. Should I sign?

No. Make them fire you. Refuse to sign the letter of resignation.

They're trying to screw you out of unemployment.
