Legal Question in Employment Law in Texas
What to do
I have worked for an equipment co. for 4 yrs. I have had health problems since around the same time. After a couple of years of going to dr.'s then neurologist they have diagnosed me with hsp, hereditary spastic paraplegia. It is a crippling disease that effects mostly the legs. There is no cure and the only thing that is keeping me walking ( hobbling ) around is a surgically implanted pump that dispenses medicine to my back.I have had 3 surgeries for this, been out of work 4 months, no income. My company has not fired me,still on their insurance thankfully,i have filed for disability,i cannot run the equipment anymore and my boss keeps promising me light duty jobs, supervising etc, but they never materialize.I think he's just putting me off.I have been told that i have to be terminated from my job before filing for unemployment.I need to know what to do in this situation, if they do find something for me to do,it would probably be part time, i can't get by on that,i know my boss doesn't want to pay unemployment, that is the reason he's stringing me along. If i quit, i'm told i can't file for it either. Any suggestions would be appreciated.

Re: What to do
If you quit, you will not be able to collect unemployment so you will need to ge terminated or laid off. Your best bet might be to go for disability. As far as the light duty jobs, your employer is not required to create a position for you.
