Legal Question in Landlord & Tenant Law in Texas
Apartment Application
This is a tricky question - basically I applied for an apartment back in Feb. to be put on a waiting list for a specific floorplan on the first floor. I applied on 2/4/07, & put down the application fee, & in good faith the admin fee & then when I signed my lease down the road I was going to put down the deposit. Well, the leasing agent I was working with called me a couple weeks later & told me everything was approved but they still needed to verify my employment, but I never actually gave them that information. It's now down to the wire & they can't provide me w/what I need, so I asked for the admin fee back - they are saying it's a fee & non-refundable, but the app. says it is if not approved. They said they approved me w/the info I put on the app at the time (which was my old employer @ a much less pay - not even one paycheck NET, let alone gross, would cover the rent there!) They are using the app for them & against me, never consistently - like the app says it will be processed within 7 days, but it wasn't, but they're saying because it was a wait list it's a diff. situation. Plus they added a date to the application when there wasn't one, and I think they're lying about calling my old employer. Do I have any hope?

Re: Apartment Application
I am somewhat confused. What exactly do you want to happen? Do you want the apartment? You can't afford it, but they are willing to take you on anyway. If they are willing to accept you and you don't want the apartment, it sounds like you are going to forfeit the fees paid. Give them your correct employment information, and if they reject you, you get your fee back.
