can an apartment complex file for an eviction 8 days after rent is due even if the rent is paid more than half and is promised the rest 3 days after?

Yes. If your lease contract is like most, rent is due on the 1st. If not paid in full on the 1st, notice to vacate can be sent on the 2d followed by filing of the eviction lawsuit.
