Apartment complex will not verify rental history
Hello, My waife and I have recently started the closing process on a new house. Our lease is up May 31, and we are expecting to be out of this current apartments by the end of the month. The only thing left that the lender needs to verify is the rental history. However, the complex refuses to verify the rental history with teh lender. We have told them that we will be paying the reletting fee, but they still refuse. Can they do this legally? Can I demand a letter stating the rental history since they will not give it to the lender? Also, after reading this site, are we responsible for the every month that the apartment doesnt get rented after paying a reletting fee? Thanks in advance...

I don't know of a way to compel the apartment complex to verify your rental history. You might try contacting the corporate management and see if they will cooperate. Why can't you just get copies of your rental checks together to show that you paid on time? Will your mortgage company accept that? If you are leaving prior to the end of the lease, you are breaking the lease. You will be responsible for a reletting fee, if it is in the lease, and rent up until the time the apartment is relet. The apartment complex does have an obligation to attempt to relet the apartment. If you are in the Dallas area, however, the vacancy rate is high and it is unlikely that the apartment will be relet before May 31. If you want to protect your credit rating, I would be prepared to pay rent for April and May.
