Legal Question in Landlord & Tenant Law in Texas

Apartment Flooded

My apartment flooded because my upstairs neighbor's washer broke-he put a load in and left - the water had no where to go but down onto me. Ruined my bedroom, kitchen and dining room and some of my possessions - what exactly are my options in regards to the apartment management? They tried to deny blame but their maintenance guy checked the washer less then a week ago and said it was fine (OBVIOUSLY not!). Do I have any rights to make demands (what I want replaced, fixed, etc)?

Re: Apartment Flooded

If the damage to your personal property is less than $5000, your simpletst option is to sue in small claims court I would name both your landlord and the upstairs tenant as defenants, since you really don't know which was responsible. Hire a lawyer to represent you in court.
