Legal Question in Landlord & Tenant Law in Texas

apartment

im currently leasing a apartment and ive noticed a lot of black colored mold in the air ducts. im concerned that it can cause health problems to my family additionally my husband has also had nose bleeds lately, we have already contacted the landlord about the matter and they have failed to do anything , my question is do i have the right to end the contract due to their negligence and due to the fact that it is not healthy to stay here? If so what do I do?

Re: apartment

That, in itself, is not a reason to legally terminate a lease. Make the request to repair in writing and keep a copy of your request. There is what I call a "back door" way to terminate your lease. Send a letter to your landlord (the on-site manager where you pay your rent) requesting the name and address of the owner. Say also that the failure to provide this information may cause you to take legal action. Send it certified mail, return receipt requested. Do that and then call me to find out what else you need to do - if they don't respond you have the right to unilaterally terminate the lease, but its a little more complicated than that, so call me.
