apartments double charging for rent

We had to get out of our lease early on an apartment, still had four months to go. The apartments told us we would be liable for remainder, but we could sublease it. We found someone, he qualified, but then the apartments came back and said they wouldn't let him on a 3 month lease. Then they rented it to someone else the next week. Now they still are charging us for 4 month, even though they have rented it. Is this legal?

Re: apartments double charging for rent

Tender to them the amount of rent due for the time the apartment was vacant. Tender it as full and final payment. See if it gets accepted. If they sue for the balance, provide your proof to the court of your tender of payment, and the re-renting of the apartment.
