Legal Question in Landlord & Tenant Law in Texas

Apartments

Hi my name is--name removed--

My fiancee and I moved in to an apartment on the 10th of August. Before we got the apartment they were giving us the run around on if we got approved or not. When we went in to sign the lease and give them the pro-rate of the first months rent they wouldnt let us walk the apartment before the signing. And they didnt offer to do so. The show apartment that they showed us looked perfect. There werent any bugs, leaks, and there was A/C. We finished signing the lease and went to look at our new place. There were roaches all over the kitchen, the bathtub has water running out of the faucet (when you arent running the water. They were aware thatthe tub had a ''leak'' b/c they told us before we got to the apartment.) We were told it would be fixed. The major thing is the A/C. Its been a week and a half and we have been unable to stay in the apartment because it is too hot. We have an infant(7months old) and she did nothing but cry while we were there. We havent been able to last 20 minutes because we start pouring sweat. We have been telling them 2-3 times a day about it since we moved in and all they say is that maintenance will be there first thing. No luck. What can we do about our situation?

Re: Apartments

Call City Code Enforcement ASAP.They can order the landlord to make repairs. The AC is certainly as issue they will address. Also, make WRITTEN requests for repairs. Seven days is considered to be a reasonable time for repairs to be made. After seven days, from written notice of need for repairs, if they aren't made, you can terminate the lease.
