Legal Question in Landlord & Tenant Law in Texas
apt lease
The apt complex my daughter lived in is refusing to return her $200.00 deposit. Can I represent my daughter in Small Claims Court?
She cannot find her copy of the contract, and does not believe she ever received one. Isn't she entitled to a copy? The owner of the address is listed as M.Barrett Co.LLC: Vehicles and Trucks. Isn't that who we need to sue?

Re: apt lease
You cannot represent her, unless you are an attorney. She will have to do this on her own, or hire a lawyer for her. As a starter, read the landlord/tenant section on the Texas Attorney General website. It is not all-inclusive, but it is a starting point. If you believe that the requirements of the statutes have been followed by your daughter, but not the complex, an attorney may be willing to represent her as he/she may be able to recover attorney fees. Good luck.
