Legal Question in Landlord & Tenant Law in Texas

breaking a lease

When I got divorced I had to break my lease and now it;s affecting my credit. Is there any way that I can make my ex-husband pay half of what is owed considering his name was also on the lease?

Re: breaking a lease

Doubtful.

If the damage was incurred after the decree was entered, then it is your debt/damage. If it was prior to the decree, then it should have been addressed prior to entry of the decree.

If the damage is severe enough to warrant hiring an attorney, you could make the argument that you had no knowledge of the damage prior to entry of the decree. It's a long shot.
