Legal Question in Landlord & Tenant Law in Texas
breaking a lease
my son rented an apartment and the lease starts this coming Aug. 19th. he was then invited to share an apartment someplace else that would be a lot cheaper for him. He immediatlry went back to his apartment and tried to get out of the lease and was told he could not. He has not moved in or paid a deposit. He was also told all bills paid, now they say electricity is only paid up to 60.00, that was not disclosed before signing. Can he get out of this?

Re: breaking a lease
Probably not. An absolute answer would depend upon the documents signed.
If he breaks the lease, the manager has an obligation to mitigate his damages. He must attempt to re-lease the apartment, and credit your son with that re-lease. Most courts will not impose lease rentals exceeding 3 months rent.
You should contact the manager, and attempt to negotiate a settlement.
