Legal Question in Landlord & Tenant Law in Texas
can i be charged for something they never did actualy see?
I have lived in my apartment for seven months now and was aware that if i got a dog i would have to pay a deposit, however i refuse to pay the deposit because i have waited seven days to have a sink disposal fixed. the landlord does not know i have the dog, no one sees him. when maintnence came in to fix it they told him i had a dog, can i be charged for this? can they come into my apartment ofter hours or when im not home to check? there is absolutely no proof from outside the apartment that i have my dog, i take him out to urinate early in the morning and late at night. i guess what im trying to ask is that if they dont see my animal can i be charged for it under suspiscion? and can they enter my home without permission because of suspicion?

If the lease says that you have a deposit, the landord would have to prove that you had a dog if you did not agree to pay the deposit. One metiod of proof would be the testimony of someone who saw you with a dog. They can enter the property to make repairs. After all, if you are renting, it is their property too.
Suggest you take your lease to an attorney so he can review it with you.
