Legal Question in Landlord & Tenant Law in Texas

Coersion.... is it illegal?

The seller of the house thatwe were purchasing has decided at the last minute to make us lease her home. She has drawn up a contract for last month to use this month charging usover 3700,00 rent in order to stay at her house. She already filed eviction on a non existant lease and is trying to force us to purchase her house by threating to put a large judgement on us if we do not pay rent for the month that we were to be closing...and pay rent for the month of Sept. She told my husband that she would drop the eviction if we would only sign her lease but she did not. Now we feel as if we were under stress or threatened to sign this lease is this admissable in court? How do I bring this to the courts attention?

Re: Coersion.... is it illegal?

This question is confusing, as it appears that you are living in her house, some six weeks prior to closing. You are not obligated to sign her lease, however, a judge may well determine that you should not be allowed to live in her house rent-free either. Until the house closes it is her house. She will be entitled to some compensation, unless you have an agreement that reads otherwise. You have some difficulty enforcing an oral agreement for the terms of the sale of a house.
