Legal Question in Landlord & Tenant Law in Texas
contract forged, later dangerous gas leak
if my name forged on contract by my son at manger's rep permission, is it legal for me to be held liable for charges, also after many notices, in writing, in person, by phone a serious gas leak not fixed, gave 8-weeks for repair, son was endangered, moved out with6 weeks left ( 2 still paid for) now after 4 years just find out they want $2,000 in back rent. I feel we were the victims. Is contract even valid, it is obviously forged. and manager and asst. knew it. There is more to story but that is basically the main part. Again, this went on 8-10 weeks, with me even being asked to leave the office as prospective renters were there and I was pretty verbal about the gas leak. I even had to go get my son out as he was asleep with the fumes. sore throat, nausea, headaches, but last time he had to be awakened by hitting windows. I even did a ''sit in'' with my car windows finger painted for 1 1/2 weeks with my boss's ok. The employees would look out window, point and talk about me. I gave them 30 days to respond to me and they did no contacts. Help! Can I be held liable for the forged contract or just my son. I really am at the point that I do not care if my now 26 year old is held liable, but I feel that all of it is fraud.

Re: contract forged, later dangerous gas leak
Your question poses many different issues. I strongly recommend you get an attorney in your area, and you may be entitled to recover your attorney fees. There may be a statute of limitations issue barring recovery. There is the forgery issue, which may be negated if your later actions approved of the lease. There are issues as to whether the apartment posed a serious health threat, and if properly notified, it terminated the lease. There may be damages available to your son, and to you. An attorney can properly assess the documentation you have to determine if a cause of action exists against the complex, and if there is still time to pursue it.
