Legal Question in Landlord & Tenant Law in Texas
Is a co-signer responsible for future leases?
My parents co-signed an apt. lease for me 4 yrs ago as I am disabled and was waiting on disability. When I re-newed my lease I was told I no longer needed a co-signer because I had disability income and signed the lease soley on my own. I re-newed the lease 2 more years after that too. I was evicted when I went to renew my lease in sept. because I was letting a homeless disabled friend stay with me. I found another place and moved as soon as possible. The apts. sent my folks a bill for over $2000. They claimed we left 21 bags of trash in the apt and 6 lg furniture items which they charged $2010 to remove. They said they had pictures. Well they sent my folks a picture of a garbage bag and the inside of the refrigerator. I admit we did not clean as well as we should have but being disabled and having to move quickly made it hard. The main thing is I don't want my folks held responsible for any charges...I signed the lease solely myself the last 3 years. Plus they have no proof of the 21 bags of trash and 6 lg items they removed for $2010!!! Please help me claim responsibility for this so they will stop bothering my parents. I am 41 yrs old...I am responsible.

Re: Is a co-signer responsible for future leases?
No. Your parents are no longer responsible, as the new leases supplanted the old one. Additionally, you have grounds to fight this. There are options available to you, but I believe you will need an attorney. If you will email me directly, I can forward some phone numbers to you, that provide legal counsel for disabled people.
